These Terms and Conditions govern your access to and use of www.exquisito.in, including purchases made through the website.

Exquisito.in is owned and operated by Loffins Inc, a sole proprietorship owned by Vinitha Jayanth, having its principal place of business at Shop No. 3, Second Floor, Door No. 20, East Kongalamman Koil Street, Manikoondu, Erode – 638001, Tamil Nadu, India.

In these Terms, “Exquisito”, “Loffins Inc”, “we”, “us” and “our” refer to the website owner and operator. “You”, “your”, “customer” and “user” refer to any person accessing the website or purchasing a product through it.

By accessing the website, creating an account or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Cancellation, Size Exchange and Refund Policy.

Eligibility

You must be legally capable of entering into a binding contract under Indian law to place an order through Exquisito.in.

If you are under 18 years of age, you may use the website or place an order only under the supervision and with the involvement of a parent or lawful guardian.

By placing an order, you represent that the information supplied by you is accurate and that you are authorised to use the selected payment method.

Customer Accounts

You may browse and purchase products as permitted by the website. Certain features may require you to create an account.

You are responsible for:

  • Providing complete and accurate account information;
  • Keeping your login credentials confidential;
  • Restricting unauthorised access to your account and devices; and
  • Informing us promptly if you suspect unauthorised use of your account.

You are responsible for activities performed through your account unless they resulted from circumstances attributable to us.

We may suspend or restrict an account where we reasonably suspect fraud, misuse, unauthorised activity or violation of these Terms.

Product Information

We make reasonable efforts to present accurate product descriptions, sizes, colours, materials, images, prices and availability.

However:

  • Colours may appear differently because of photography, lighting and device-display settings;
  • Product measurements may have minor manufacturing variations;
  • Handcrafted, dyed, printed or embellished products may have minor variations between individual pieces; and
  • Packaging may occasionally change without materially affecting the product.

Such minor variations will not ordinarily constitute a defect. This does not affect your rights if a product is materially different from its description, defective, damaged or incorrectly supplied.

Customers should review the product description, size chart, measurements, wash-care instructions and other information before ordering.

Prices and Taxes

All prices are displayed in Indian Rupees unless stated otherwise.

Unless expressly mentioned, displayed product prices are inclusive of applicable GST. Shipping charges and any applicable taxes or fees will be shown at checkout before payment.

We may change product prices at any time. A price change will not ordinarily affect an order that has already been accepted, except where there is an obvious pricing or technical error.

Promotions and Discount Codes

Promotional offers, coupons and discount codes may be subject to additional conditions, including validity periods, minimum order values, eligible products and usage limits.

Unless expressly stated:

  • Only one coupon may be used per order;
  • Coupons cannot be exchanged for cash;
  • Coupons cannot be applied retrospectively;
  • Discounts may reduce the merchandise value used to determine free-shipping eligibility; and
  • We may withdraw or correct an offer affected by fraud, misuse or an obvious error.

Placing and Accepting Orders

Products displayed on the website constitute an invitation to place an order and not an unconditional offer to sell.

After you place an order, we may send an automatic acknowledgement containing an order number. This acknowledgement confirms receipt of the order but does not necessarily constitute final acceptance.

An order is ordinarily accepted when it is processed for dispatch.

We may cancel or decline an order before dispatch for reasons including:

  • Product unavailability;
  • Incorrect pricing or product information;
  • Payment failure;
  • Suspected fraud or unauthorised payment;
  • An incomplete or unserviceable delivery address;
  • Quantity restrictions;
  • Technical errors; or
  • Circumstances beyond our reasonable control.

If we cancel a prepaid order for a reason not attributable to the customer, we will initiate a full refund to the original payment method.

Product Availability

All orders are subject to product availability.

Adding a product to the cart or wishlist does not reserve it. In rare cases, a product may become unavailable after an order is placed because of simultaneous orders, inventory errors or quality-control rejection.

If an ordered product becomes unavailable, we will contact the customer and provide an appropriate resolution, including a refund where applicable.

Payments

Orders must be paid using one of the payment methods available at checkout. Cash on Delivery is currently unavailable.

Payments may be processed by independent banks, card networks, UPI providers or payment-gateway service providers. Their processing may be governed by their respective terms and privacy practices.

We do not guarantee that every payment method will always remain available.

An order is not confirmed for processing until payment is successfully authorised. If money is debited but the order is not confirmed, please contact us with the transaction details. Resolution time may depend on the relevant bank or payment provider.

Shipping and Delivery

Orders are shipped according to our Shipping Policy.

Shipping is free when the final merchandise value is ₹399 or more after coupons and discounts. For orders below ₹399, the applicable shipping charge will be displayed at checkout.

Orders are ordinarily dispatched within 1–3 working days, and delivery is ordinarily estimated within 2–7 working days after dispatch.

Delivery dates are estimates and may be affected by courier operations, destination, weather, public holidays, local restrictions and other circumstances beyond our reasonable control.

Customers are responsible for providing accurate delivery and contact information.

Cancellations, Exchanges and Refunds

Order cancellations, size exchanges, returns and refunds are governed by our Cancellation, Size Exchange and Refund Policy.

In summary:

  • Eligible orders may be cancelled for a full refund before dispatch;
  • Actual forward and return shipping expenses may be deducted when cancellation is requested after dispatch;
  • Eligible apparel may qualify for a size exchange when requested within seven calendar days of delivery;
  • Size exchanges are subject to availability and applicable shipping charges;
  • Refunds are not provided merely for a change of size, colour, design or preference; and
  • Defective, damaged or incorrectly supplied products may qualify for a replacement or refund after verification.

The complete policy applicable on the order date should be reviewed before purchasing.

Custom-Printed and Personalised Products

Customers are responsible for checking all names, spelling, sizes, colours, images and other customisation details before approving a personalised order.

Once production has begun, a custom-printed, personalised or made-to-order product may not be cancelled, changed, returned or exchanged merely because the customer changes their mind or supplied incorrect information.

This restriction does not apply where the product is defective, damaged or does not conform to the customisation approved by the customer.

Acceptable Use

You must not:

  • Use the website for any unlawful or fraudulent purpose;
  • Attempt to gain unauthorised access to the website, accounts, servers or systems;
  • Introduce malware, malicious code or harmful technology;
  • Interfere with the website’s operation or security;
  • Scrape, copy or extract website content through automated means without permission;
  • Impersonate another person;
  • Submit false reviews or misleading information;
  • Use another person’s payment information without authorisation; or
  • Infringe our rights or the rights of another person.

We may restrict access where these conditions are violated.

Intellectual Property

Unless otherwise stated, the website’s design, text, product descriptions, photographs, illustrations, graphics, logos, brand elements and other original content are owned by or licensed to Loffins Inc.

The trademarks and brand identities displayed on the website, including those associated with Exquisito, Watch Me Fly and Vrihaya, may not be copied, reproduced or used without the respective owner’s written permission.

You may use the website only for personal and lawful shopping purposes. No content may be reproduced, commercially exploited, republished or distributed without permission, except as allowed by law.

Reviews and Customer Content

If you submit a product review, photograph, comment or other content, you confirm that:

  • The content is based on your genuine experience;
  • You have the right to submit it;
  • It is not unlawful, defamatory, abusive, obscene or misleading;
  • It does not infringe another person’s privacy or intellectual-property rights; and
  • It does not contain malicious code or unauthorised advertising.

You grant Loffins Inc a non-exclusive, royalty-free right to display and use the submitted content in connection with the website and our products, subject to applicable privacy law.

We may moderate or remove content that violates these Terms. We will not suppress a genuine review merely because it is critical.

Third-Party Links and Services

The website may contain links to social-media platforms, payment providers, courier tracking services or other third-party websites.

We do not control third-party websites and are not responsible for their independent content, availability, security or privacy practices. Customers should review the terms and policies of those services before using them.

Website Availability

We endeavour to keep Exquisito.in available and accurate, but uninterrupted or error-free operation cannot be guaranteed.

We may temporarily restrict access for maintenance, security, upgrades or circumstances beyond our control. We may also change or discontinue website features without prior notice, provided this does not affect rights already accrued under an accepted order.

Limitation of Liability

To the extent permitted by law, Loffins Inc will not be liable for indirect or consequential losses that were not reasonably foreseeable and did not arise directly from our breach.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct or rights and remedies available under applicable consumer law.

Force Majeure

We will not be responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, government restrictions, strikes, transport disruption, courier interruption, telecommunications failure or internet-service interruption.

We will make reasonable efforts to minimise disruption and communicate material delays.

Consumer grievances will be acknowledged within 48 hours and addressed within one month from the date of receipt, in accordance with applicable law.

Governing Law and Disputes

These Terms are governed by the laws of India.

We encourage customers to contact us first so that we can attempt to resolve a concern through our grievance-redressal process.

Subject to applicable consumer law and the jurisdiction available to consumers under it, other disputes relating to these Terms or transactions through Exquisito.in will be subject to the competent courts in Erode, Tamil Nadu.

Nothing in this clause restricts a consumer from approaching a competent Consumer Commission or another authority having jurisdiction under applicable law.

Changes to These Terms

We may update these Terms to reflect changes in law, technology, website functionality or business operations.

Updated Terms will be published on this page with a revised “Last updated” date. Material changes will ordinarily apply prospectively and will not reduce rights already accrued under an accepted order unless required by law.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
